Competent and Qualified Persons: A Data Center Construction Role Evidence Check

October 16, 2026 · Cortex Construct

A competent person and a qualified person are different role concepts in OSHA's construction definitions. A workforce coordinator should record the specific work, supporting capability evidence and employer authority required for the role, rather than treat a senior job title or training card as a universal designation.

This guide is an administrative aid for data center construction coordination. It does not assess an individual's competence, select a person for employment, appoint a safety role or authorize work. The responsible employer and site safety owners apply the requirements for the actual activity.

What do the construction definitions distinguish?

OSHA's construction definitions in 29 CFR 1926.32 distinguish three useful concepts. Paragraph (f) combines the ability to recognize relevant hazards with authority to take prompt corrective action for a competent person. Paragraph (m) describes demonstrated ability concerning the relevant subject or work, supported by recognized qualifications or extensive knowledge, training and experience. Paragraph (d) separately addresses an employer-approved or assigned authorized person.

These are paraphrases of the general construction definitions. Specific activities can add their own requirements. Cortex Construct is independent and is not affiliated with OSHA. This page does not turn the general definitions into an all-purpose credential or give a legal opinion about a particular appointment.

What belongs in a role evidence check?

Start with the exact duty, work area and employer, followed by the actual applicable requirement. A role label in a staffing request is an input to clarify, not proof that the person assigned already meets it. Keep personal certificates and assessment records in the approved restricted system; use controlled references in the coordination copy.

FieldEvidence to connectGap to resolve
DutySpecific activity and applicable requirementAvoid a blanket site-wide title
CapabilityEmployer-reviewed evidence relevant to that dutyA generic course may not cover it
Corrective authorityActual employer authority where requiredKnowledge alone does not establish authority
Qualified basisRelevant demonstrated ability and supporting recordDo not infer it from seniority alone
AssignmentEmployer decision, scope and effective referenceCoordinator must not appoint by inference
ChangeNew task, employer or scope requiring reviewDo not silently carry a designation forward

The register does not require every role to carry every label. The safety owner first determines which role and requirements apply. Record the actual decision and open evidence requests instead of selecting all labels to make a staffing form look complete.

Why can experience leave an authority gap?

Illustrative example. A fictional staffing request asks for a competent person for a specifically defined construction activity. The coordination file contains a supervisor job title and a general training record. It contains neither the employer's task-specific capability assessment nor evidence of the required corrective authority.

The coordinator records evidence pending and routes the request to the responsible employer and safety owner. They do not declare the person incompetent, appoint that person, or treat the missing record as permission to start work. The example contains no actual worker information or selection decision.

If the employer later confirms the assignment, retain its actual scope and evidence references. Confirmation for one activity should not be rewritten as a universal designation for unrelated work. A changed task or employer requires the responsible owner to check what carries across.

How does this connect to training and task planning?

Use the OSHA Outreach card review for the separate question of what a course-completion card establishes. The task-change and JHA register connects changed work conditions to the current analysis and briefing evidence. Neither page supplies a role appointment.

Keep role evidence, task controls, permits and engineering approvals as distinct records with responsible owners. Engineering sign-off is performed only by the registered engineer on the job. No worksheet, course card or staffing discussion replaces the applicable site work-release process.

Frequently asked questions

Does a supervisor title establish competent-person status for every task?

No. The responsible employer must address the actual activity, capability and authority required.

Are competent, qualified and authorized interchangeable labels?

No. Preserve the applicable definitions and the actual task-specific assignment basis.

Does this register authorize work or appoint a person?

No. It records evidence and unresolved questions for the responsible employer and safety owners.
