Travel between job sites during the workday needs a different hours-worked review from ordinary home-to-work commuting. For a US data center construction assignment, record the actual journey, workday context and employer instructions before treating every crew transfer as the same type of travel.
This is a planning and recordkeeping aid, not legal or payroll advice. The responsible employer and qualified payroll or employment-law adviser must determine coverage, applicable federal and state rules, agreements and the actual treatment. It does not decide worker classification, an individual's entitlement or a universal travel payment rate.
What distinction does the federal guidance make?
US Department of Labor Fact Sheet 22, checked on 22 October 2026, distinguishes ordinary home-to-work travel from travel that is part of the principal activity during the workday. Its example of travel from job site to job site during that workday is work time that must count as hours worked under the described FLSA framework.
The fact sheet treats special one-day assignments and overnight travel in separate sections. Those different categories are reasons to retain facts, not to apply one commuting label to every journey. Cortex Construct is independent and is not affiliated with the Department of Labor. The fact sheet is general guidance and does not resolve every applicable state rule or individual situation.
Which journey facts should the coordinator retain?
A transport booking shows an arrangement was made. It does not, by itself, establish the hours-worked category or the actual elapsed travel. Keep the planning record linked to the employer's authorised timekeeping process.
| Journey field | Evidence to retain | Review question |
|---|---|---|
| Leg | Actual origin and destination | Home, assignment or worksite transfer? |
| Workday context | Approved assignment and timing | Before, during or after work activities? |
| Instructions | Responsible employer's direction | What was required? |
| Actual time | Authorised time record | What occurred rather than forecast? |
| Purpose | Task or assignment reference | What work context applies? |
| Review | Payroll or legal decision reference | Which rule and facts were assessed? |
| Change | Revised route or assignment | Does the recorded treatment still apply? |
Use role or assignment references in shared planning material. Keep personal time records, home addresses and individual payroll details in the employer's restricted system. A shared crew logistics worksheet should not become a public payroll record.
How can a common travel label hide different facts?
Illustrative example. A fictional roster includes an ordinary journey from home to the first worksite and a later employer-directed transfer from one worksite to another during the workday. The coordinator groups both legs under commute because the same vehicle booking covers them.
The useful handoff separates the two legs and records their actual context. The employer's qualified reviewer determines the applicable treatment and updates the authorised time record. This example does not calculate a worker's pay, decide that all vehicle time is compensable or determine a particular individual's coverage.
What should happen when the assignment changes?
If a crew is redirected to another worksite, retain the changed instruction, timing and actual journey. Ask the responsible payroll function to review any classification carried over from the old plan. Do not erase the earlier record or infer the new decision from the booking's commercial payer.
The crew transfer scope worksheet identifies who arranges a journey. The training-time review addresses a separate hours-worked question. A supplier paying for transport does not settle the employer's wage-and-hour responsibilities.
Does a transport booking prove the actual travel time?
No. Keep the authorised record of what occurred and its workday context.
Can all travel be marked unpaid commuting?
No. Different journey categories require the applicable factual and legal review. Do not decide treatment from a generic label.
Does this worksheet calculate a travel payment rate?
No. The responsible employer and qualified advisers determine applicable treatment and pay. No rate or individual entitlement is supplied here.
