A two-week pay period is not permission to average two workweeks when checking the standard federal overtime rule. For covered, nonexempt workers under that rule, keep each fixed workweek's actual hours separate before payroll determines overtime pay.
This is an administrative planning worksheet for US data center construction assignments, not a legal opinion, worker classification decision or payroll calculation service. State rules, public-contract obligations, agreements and lawful exceptions need their own review. Do not use this worksheet to reduce or withhold compensation.
Which rule does the official source describe?
US Department of Labor Fact Sheet 23, revised October 2019, describes the general FLSA overtime requirement for covered employees unless specifically exempted. It uses a fixed, recurring 168-hour workweek and says hours cannot be averaged over two or more weeks.
The workweek need not match the calendar week. A fortnightly payroll cycle is a different administrative period. These points concern the standard federal framework described in the fact sheet, not a conclusion that every worker or arrangement has identical treatment. Cortex Construct is independent and is not affiliated with the Department of Labor.
The designated employer and qualified payroll or legal reviewer must establish coverage, exemptions, the actual workweek and all applicable rules. A staffing coordinator should preserve those approved inputs rather than invent them from a roster.
Which fields should the workforce reconciliation retain?
Start with the employer's confirmed workweek boundary. Reconcile actual hours through the approved timekeeping process, including corrections, rather than substitute planned coverage for time actually worked. A worker moving between workfronts does not justify dropping part of the week's record.
| Reconciliation field | Evidence to retain | Review question |
|---|---|---|
| Employer and assignment | Approved employment and assignment reference | Who owns the payroll determination? |
| Workweek boundary | Confirmed start day, time and time basis | Which week contains each actual hour? |
| Actual hours | Authorised time records and corrections | Does the complete record reconcile? |
| Pay period | Actual payroll cycle | Is it being confused with the workweek? |
| Applicable treatment | Payroll or legal determination | Which federal, state or contractual rules apply? |
| Change and approval | Original record and disposition | Was a correction preserved rather than overwritten? |
Use controlled worker references and restrict access to personal payroll records. A public recruitment enquiry should not contain an employee's private wage or timekeeping documents.
What can a two-week average hide?
Illustrative example. A fictional worker has 30 actual hours in one fixed workweek and 50 in the next. Assume the worker is covered and nonexempt under the standard over-40 federal rule, all stated hours are hours worked, and no special exception changes that basis. The total is 80, but dividing by two to show an average of 40 hides the second week's 10 hours above 40.
This example identifies hours requiring review under its stated assumptions; it does not calculate money owed. The actual regular rate, statutory exclusions, state requirements and any additional obligations still need qualified payroll review. No hourly wage, current market rate or real worker record is supplied.
A plan for 40 hours in each week does not replace the actual 30 and 50 records. Nor should a coordinator move the established workweek boundary or reassign hours merely to make an average look acceptable. Keep the original evidence and obtain an authorised disposition.
How should shift handover support the review?
The construction shift handover checklist helps preserve assignment changes and unresolved issues. Add the actual timekeeping reference and responsible employer contact where the approved process requires them. A site-access log or planned crew roster is supporting information, not automatically a complete record of compensable hours.
Before a proposed roster change, ask the employer's designated reviewer to assess the actual treatment. Preserve later corrections and their reasons. Planning approval is not a waiver of statutory pay requirements.
Frequently asked questions
Does a fortnightly pay cycle create an 80-hour overtime threshold?
Not under the standard federal rule described here. Check each fixed workweek separately.
Does every workweek begin on Monday?
No. Use the employer's actual fixed and recurring boundary.
Does this guide decide whether a worker is exempt?
No. Obtain the actual qualified payroll or legal determination.
